In the Prius, a "planetary gear" is used as a power split device, providing a three-way connection between the wheels (and by extension motor/generator "M"), the gasoline engine, and generator/motor "G". The easiest way of thinking of the planetary gear is that the rotation of the wheels is always equal to the sum of the gasoline engine rotation and the rotation of generator/motor "G".

This means that the gasoline engine may be stationary, with any rotation of the wheels being directed towards rotation of generator/motor "G". It also means that if the gasoline engine is turning at a fixed speed, the faster the car is moving, the slower generator/motor "G" will turn.

In a typical driving situation, the output from the Prius's gasoline engine is split between the wheels and generator/motor "G". If the batteries are sufficiently charged, all energy coming from generator/motor "G" will also be routed to the wheels, by using it to power motor/generator "M". This means that power is taking two separate paths from the gasoline engine to the wheels, one entirely mechanical, and the other partially electrical.

Ultimately, the effectiveness of patent protection cannot be tested unless subject to legal challenge. However, as at the date of this document the Directors are not aware of any action being taken in respect of Antonov Group’s patents and with regard to patent applications pending no prior act has been identified which Pontet & Allano consider would prevent the patents from being granted.
Huh... The action was originally filed on the 12th April 2005, but the first hearing date was postponed to allow more time for negotiations to seek a satisfactory settlement.

Nu de vraag: Waarom hebben ze het patent EP 0414782 (Toyota case) buiten dit warrant rapport gehouden?

Misschien dat dit het antwoord is:
In het rapport worden deze patenten als key-patents genoemd.
Waarschijnlijk omdat het "Toyota-patent" nog maar 4 jaar geldig is wordt deze niet als key-patent gezien. Dat belooft dus nog wat.

Antonov sleept Toyota voor de rechter
AMSTERDAM (ANP) - Ontwerper van automatische versnellingsbakken Antonov sleept de Japanse autofabrikant Toyota in Duitsland voor de rechter wegens patentbreuk. De Japanners maken volgens Antonov oneigenlijk gebruik van zijn versnellingsbaktechnologie voor het hybride Toyota-model Prius en de Lexus RX400h. Dat maakte het Brits-Nederlandse bedrijf maandag bekend. De zaak was al op 12 april dit jaar ingediend, maar komt pas deze week voor de rechter. De partijen probeerden er eerst nog zelf uit te komen. Maar Toyota heeft geen toereikend voorstel gedaan, zei Antonov-directeur John Moore in een toelichting. Toyota was niet bereikbaar voor commentaar. Antonov en Toyota blijven ondertussen wel praten over een schikking. Een uitspraak van de rechter in Düsseldorf wordt binnen twaalf maanden verwacht. Antonov koos naar eigen zeggen voor een gang naar de rechter in Duitsland omdat juridische procedures daar relatief sneller en daardoor goedkoper kunnen worden afgewikkeld. Hoeveel Antonov uit de rechtszaak denkt te slepen, wil het bedrijf niet zeggen. "Maar het gaat om honderdduizenden verkochte auto’s waarbij je moet denken aan gemiste royalties van enkele tientallen dollars per stuk", zei Moore. Het aandeel schoot maandagmiddag prompt met 10 procent omhoog tot 1,77 toen het persbericht naar buiten kwam. Het aandeel is zeer populair bij speculanten. Om 16.00 uur gingen er bijna 400.000 aandelen in om. Antonov heeft sinds de gang naar de beurs in Amsterdam in 1997 alleen nog maar verlies geleden. Het bedrijf, in 1991 opgericht door de Franse ontwerper Roumen Antonov, wist op de been te blijven door de uitgifte van nieuwe aandelen en bankleningen. Tot nu toe heeft Antonov een licentie-overeenkomst weten te tekenen met één grote autofabrikant, namelijk Honda. Verder maakte Antonov voor Opel en Suzuki prototypen van automatische versnellingsbakken. Daaruit zijn echter nog geen orders voortgekomen. Onlangs maakte het bedrijf, dat ook in Londen een beursnotering heeft, bekend dat het volgend jaar op de allereerste omzet rekent van minimaal 2 miljoen euro met de verkoop van turboaandrijvingen. In 2007 zou het dan quitte kunnen draaien.

'Toyota breekt Antonov-patent'

Antonov beticht Toyota ervan inbreuk te plegen op haar patenten middels de aandrijflijn voor de Prius en de (Lexus) RX400h. In Düsseldorf zal daarom op 22 september de eerste hoorzitting worden gehouden waarin beide partijen hun standpunten kunnen belichten.
Antonov heeft al op 12 april 2005 melding gemaakt van de inbreuk maar de hoorzitting is uitgesteld om te onderhandelen over een schikking. Toyota heeft als tegenzet de geldigheid van het betreffende patent (EP 0414782) aangevochten bij de rechtbank in München. Omdat de partijen niet tot een schikking zijn gekomen, zal Antonov de genoemde zaak voortzetten. Dat de zaak nu pas bekend wordt gemaakt heeft te maken met de eerdere pogingen tot het schikken van de zaak. Als beursgenoteerde onderneming moet de zaak na het mislukken van de schikking en het voortzetten van de rechtzaken wel openbaar gemaakt worden.
Het doel van Antonov is om de vermeende inbreuk te laten vaststellen en vervolgens een vergoeding te laten vaststellen per verkochte dan wel te verkopen auto met het genoemde aandrijfsysteem, net zo lang totdat het patent verloopt. Dat de zaak in Duitsland voor de rechtbank komt, is volgens Antonov een gevolg van het 'relatief snelle en kosteneffectieve proces naar een bindende uitspraak'.

Antonov sues Toyota

Motor vehicle technology developer Antonov has launched a patent infringement action against Japanese car giant Toyota in Germany.

AIM-quoted Antonov, which is working on products to use the energy from transmission for gear changes in an economic way, alleges that the driveline installed by Toyota in its Prius and Lexis RX400h hybrid cars breaks its Patent EP 0414782. John Moore, an experienced industry figure who became chief executive of Antonov in January, says a preliminary hearing in Düsseldorf is set for Thursday.

'It is like poking a giant with a sharp stick,' comments Moore, who says loss-making Antonov first heard early this year there might be a possible infringement. The two companies have since then been negotiating a possible settlement, but, he adds, a recent offer from Toyota was not acceptable.

He says Antonov chose Germany as the place to sue because the system there is simple, 'non-adversarial' and relatively inexpensive. Antonov, which lost £775,000 in the first quarter of this year, has set aside £68,000 for the case and expects judgement, which will have legal force throughout Europe, next summer.

Toyota, for its part, has filed a counter-suit in Munich, alleging that the patent claimed by Antonov is not valid. Perversely, a decision in that case is not expected until a year to 18 months after judgement in Antonov's Düsseldorf action.

Even more ironically, according to Moore, Antonov, whose claimed patent runs until 2009, would need technology patented by Toyota to install the driveline into car gearboxes anyway. Essentially, this is a dispute about royalties between now and 2009.

Moore argues the Toyota litigation should be seen as a sideshow to Antonov's central projects: a small two-speed drive engine, a supercharger drive and a front-end accessory driver to run air conditioning and other functions at low as well as high speeds. The company was working with MG Rover and is now talking to Shanghai Automotive Industry Corporation about incorporating its technology into future gearboxes.

Floated by broker Brewing Dolphin at 24p ten years ago, Antonov shares grazed 190p in spring 2004, but now trade at 106.5p, valuing the company at £31.4 million. The appeal is decidedly speculative.

After many months of negotiations, Antonov has commenced legal proceedings against Toyota for patent infringement in the German courts. The infringement relates to an integral part of the Toyota hybrid gearbox that permits variable electrical assistance, whose key use so far has been the Toyota Prius (Car of the year 2005) – see the patent application and the Toyota schematic at the end of this note. The patent was filed in 1989.

The use of the German courts is significant. Patent cases are held in two courts that can run in parallel; patent infringement in Düsseldorf and patent validity in Munich. The stages take place in a limited time frame (patent infringement up to 12 months and patent validity up to 24 months) and, more importantly, with set costs of €100,000 for each stage. Antonov has started its formal proceedings for patent infringement this afternoon with written submissions ahead of the Judge’s preliminary hearing on Thursday. Preliminary judgement, relating to whether a patent infringement has taken place, is expected in January and the whole process will be complete within 12 months.

Toyota begun its counter-claim of patent validity less than a month after Antonov filed for patent infringement and therefore the initial hearing for patent validity should be within a month. A suitable challenge to the patent would be to show an earlier application – we do not expect them to succeed as the patent has been in place for some 16 years.

Toyota has offered Antonov an out of court settlement but this has not been accepted and whilst it can offer a settlement at any time, once Toyota has lost the patent infringement case, Antonov would surely have a much stronger bargaining position. This is because the German court system could give Antonov the right to block the sale of Prius’ in Europe and the right to claim for lost royalties.

The case launched will only address the cars sold in the EU that have utilised the patent. Of the 350,000 Prius’ sold to date, some 14,000 have been sold in Europe with the majority sold in the US and the Japanese home markets. However, the outlook is for substantial volume growth with Toyota forecasting some 20,000 sales in Europe alone next year.

Unfortunately the patent does not apply in the US where patents cannot cover an application, only a "widget". However, the patent is held in Japan and patent lawyers have indicated their belief in a strong case which would have a material benefit as, currently, all of Toyota’s hybrids are manufactured there.

Potential royalties will be substantial as the same gearbox is in use in the new hybrid Lexus RX 400h SUV and has been licensed to Ford and Nissan amongst others.

We remain positive on Antonov, reflecting our belief that its innovative gearbox technology is set for significant adoption.

Before Rover Power-train went into receivership Antonov had formed a relationship with them. With the acquisition of Rover, Shanghai Automotive Industry Corporation and Nanjing Automotive have acquired the rights to the Rover designs (bar the MG SV concept sports car), a range of engines covering diesels up to multiple-bank engines but they have limited access to modern gearboxes and those are normally restricted to sale within the Chinese market. Antonov is perfectly positioned to supply gearboxes to the vast and fast growth Chinese automotive market and the potential of growing Chinese exports.
Commercial acceptance of its technology is also being shown with the launch of the ‘light’ version, a mechanical automatic 2 speed gearbox that is being proven as an add-on to Rotrex superchargers. Antonov recently announced NZWL as the volume manufacturer and we would expect to see major manufacturers moving to adopt the technology, both in boosting intakes as well as reducing fuel consumption by gearing down the load from ancillary equipment, such as alternators, air-conditioning pumps and power steering.

Finally, we believe Antonov’s gear train solution to dual-clutch automatic gearboxes offers substantial size, weight and efficiency gains over the existing attempts at redesigning this 1936 innovation. Although Antonov is offering only the gear design we believe this is potentially a significant boost in the more medium term.

Against Torotrak with a £48.9m EV (Market cap £56.2m at 47p and £7.3m cash), Antonov’s EV of just £27.5m (Market cap £31.3m at 106.5p and estimated net cash of £3.8m as well as a further €6m facility in place) looks too low. Antonov already has a commercial license with Honda and with Rotrex and should therefore sit at a premium to Torotrak. Buy.

Antonov Plc geeft update over patentbreuk door Toyota
In april 2005 heeft Antonov Plc, de autotechnologie onderneming, een rechtsvordering ingesteld tegen Toyota bij de rechtbank in Düsseldorf wegens de schending van haar patenten. Het betreft de techniek die is toegepast in de driveline van de Toyota Prius en de Lexus RX400h. Van belang is tevens dat Antonov van mening is dat Toyota licenties heeft verstrekt om de technologie in de producten van andere fabrikanten te gebruiken.
Na uitstel door Antonov om onderhandelingen met Toyota tot een voor beide partijen toereikende schikking te komen, vond de eerste hoorzitting in de zaak plaats op 22 september 2005.
Tot op heden bevat het voorstel van Toyota geen redelijke compensatie voor het gebruik van het intellectuele eigendom van Antonov in alle voertuigen die tot op heden verkocht zijn, en voor het aantal dat nog verkocht zal worden tot op het moment van het aflopen van de patenten. Antonovs patenten gelden in het Verenigd Koninkrijk, Duitsland, Frankrijk, Spanje, Italië en Japan.
Op de hoorzitting van 22 september 2005 heeft de rechtbank in Düsseldorf, in overeenstemming met de verwachtingen van Antonov, de volgende agenda opgesteld.
De hoorzitting zal plaatsvinden op 29 augustus 2006. Voorafgaand aan deze hoorzitting heeft de rechtbank een agenda opgesteld zodat beide partijen hun verweer kunnen voorbereiden. Toyota heeft tot 16 januari 2006 de tijd om te reageren op het door Antonov ingediende bevelschrift. Antonov is vervolgens tot 2 mei 2006 in de gelegenheid om hierop te reageren. Toyota heeft vervolgens tot 7 augustus 2006, vlak voor de hoorzitting, de laatste mogelijkheid om haar verdediging te verfijnen.
Antonov besloot tot juridische stappen over te gaan na zorgvuldig beraad met juridische experts en experts op het gebied van patentrecht en de auto-industrie. De zaak is aanhangig gemaakt in Duitsland omdat, zoals reeds eerder vermeld, het Duitse rechtssysteem de mogelijkheid biedt om relatief snel en tegen redelijke kosten een juridisch bindende uitspraak te krijgen. Antonov verwacht dat de kosten voor het gehele proces circa EUR 100.000,- zullen bedragen.
John Moore, CEO van Antonov: "We zouden geen juridische stappen tegen Toyota hebben ondernomen als we niet het vertrouwen hadden dat we sterk staan. Het is van groot belang dat we onze patenten beschermen en compensatie in de vorm van royalties eisen voor alle producten die geproduceerd of verkocht worden in de landen waar onze patenten gelden. Naast schending van onze patenten zijn wij van mening dat Toyota licenties met betrekking tot deze technologie aan andere fabrikanten verstrekt. Antonov Plc ("the Company") announces update On Toyota Patent Infringement
In April 2005, Antonov Plc, the automotive technology company, filed an infringement action against Toyota, at the Patent Court in Düsseldorf alleging infringement of its patents by the driveline of the Toyota Prius and Lexus RX400h. The Company, importantly, also believes that Toyota has licensed the technology for use in other manufacturers' products. The case received its preliminary hearing on September 22nd 2005 having previously been postponed by the Company to allow further negotiations with Toyota in order to reach a satisfactory settlement.
To date, Toyota's offer does not reflect a fair payment for the use of Antonov's intellectual property in all relevant vehicles sold to date and for those that will be sold through to the expiry of the patents. Antonov's patents cover the UK, Germany, France, Spain, Italy and also Japan.
As a result, and in line with Antonov's expectations, the Patent Court in Düsseldorf announced the following timetable at the hearing on September 22nd.
The oral hearing for the case is scheduled for August 29th 2006. Prior to this hearing, the courts have set a timetable for the parties to prepare their submissions. Toyota has until January 16th 2006 to respond to Antonov's writ. Antonov is then provided with the opportunity to address Toyota's response by May 2nd 2006. Toyota then has a final opportunity to refine their defence by August 7th 2006 shortly before the oral hearing.
Antonov's legal action was taken after a process of in depth consultation with patent, legal and automotive industry experts. The action has been taken in Germany, as detailed previously, as the German legal system provides a relatively rapid and very cost effective route to a legally binding decision. Antonov expects that the entire process should cost in the region of EUR100,000.
John Moore, Antonov's CEO commented:
"We would not take legal action against Toyota unless we were confident that we had a strong case. It is important that we protect our patents and seek royalty payments in respect of all products manufactured or sold in the territories where our patent cover exists. We believe that Toyota has both infringed our patents as well as licensed this technology to other manufacturers. We will continue to seek a negotiated settlement but have made provision to pursue the case through the courts if this proves to be necessary."

Antonov: schikking Toyota onvoldoende
AMSTERDAM (Dow Jones) - Antonov, de Brits-Nederlandse ontwerper van automatische versnellingsbakken, vindt het schikkingsvoorstel van autofabrikant Toyota ter vergoeding van de inbreuk op Antonovs patenten, onvoldoende.
’Toyota’s schikkingsvoorstel staat niet in verhouding tot het oneigenlijk gebruik van Antonovs intellectueel eigendom’, stelt Antonov.
In april dit jaar sleepte Antonov Toyota voor de rechter in Dusseldorf, omdat het van mening is dat de Japanse autofabrikant bij haar modellen Toyota Prius en Lexus RX400h een inbreuk maakt op de gepatenteerde versnellingsbaktechnologie van Antonov.
Op 22 september vond een eerste hoorzitting plaats in deze kwestie, waarin een definitief vonnis niet wordt verwacht voor de zomer van 2006. Tot die tijd zullen de partijen pogen tot een vergelijk te komen.

Update on Toyota Patent Infringement Case
Antonov, the innovative automotive technology company, today clarified the timescale in which the patent infringement case with Toyota will proceed. The case relates to a CVT design which boosts the drive from an engine with an electric motor and is an integral part of Toyota’s hybrid power train. It is currently being used on the Toyota Prius (over 320,000 produced to date), the Lexus RX400h and has also been licensed to Nissan, Ford, Porsche and Daihatsu.

The case is being held in the German courts due to the low costs (circa. €100,000) and fixed timescale:

16 January 2006 - Toyota to respond to Antonov’s writ
2 May 2006 - Antonov to address Toyota’s response
7 August 2006 - Toyota’s final opportunity to refine defence
29 August 2006 - Oral hearing
If the procedure goes through to completion, Antonov would have the right to block sales of cars using the infringed patent within the EU jurisdiction; a very powerful bargaining tool indeed but unlikely to be used.

Toyota has already offered a settlement. Antonov, however, has stated that this does not reflect a fair payment for the IP.

We estimate the volume of Prius’, alone, built to date and in the future as:

Assuming a royalty of $20 per car would lead to a figure of $16m (£9m). We would expect any German court to take into account other models using the license from Toyota which could lead to a settlement of up to €40-60m (£28-41m). In comparison to Antonov’s current market capitalisation of £30m we expect this to lead to a significant re-valuation.

We expect Antonov’s first commercial revenues to begin in Q4 this year from sales of a 2 speed gearbox incorporated into a Rotrex supercharger. Antonov’s 6 speed and Dual Clutch gearbox are in a production planning stage and we expect these to generate initial revenues in 2007.
